Bylaws to amend the Town of Peace River Land Use Bylaw No. 1891

Pursuant to Section 606 of the Municipal Government Act, being Chapter M-26 of the Statutes of Alberta, notice is hereby given that the Council of the Town of Peace River will hold a Public Hearing before the second reading of Bylaw No. 2033 and/or Bylaw No. 2038 to amend the Town of Peace River Land Use Bylaw.

Bylaw No. 2033 and 2038 are two (2) options for the enabling of cannabis-related uses in the Town of Peace River, as well as specific use regulations associated with each cannabis related use. The key provisions for both bylaws are as follows:

 Option 1 – Bylaw 2033

Establishes a 100m separation distance for cannabis retail sales from:

  • a private or public school
  • a provincial health care facility

Enables Cannabis Retail Sales as a discretionary use in the following districts:

  • Primary Commercial
  • Highway Commercial
  • Commercial – Shopping Centre

Enables Cannabis Production Facility as a discretionary use in the following districts:

  • Light Industrial
  • Mixed Industrial-Business

Option 2 – Bylaw 2038

Establishes a 100m separation distance for cannabis retail sales from:

  • a private or public school
  • a provincial health care facility
  • a public playground

Provides up to a 10m variance to the separation distance in specific circumstances.

Establishes a pre-decision notification process for landowners within 50 m for discretionary use applications or variance applications.

A requirement to consider the impact of clustering has been added, similar to the regulation of liquor stores.

Enables Cannabis Retail Sales as a permitted use in the following districts:

  • Primary Commercial
  • Riverfront Development
  • Mixed Commercial-Residential

Enables Cannabis Retail Sales as a discretionary use in the following districts:

  • Highway Commercial
  • Commercial – Shopping Centre

Enables Cannabis Production Facility as a discretionary use in the following districts:

  • Light Industrial
  • Mixed Industrial-Business
